Terms and Conditions
These terms apply to your use of this site and to any order you place with us. Please read them before you buy.
1. Who you are buying from
This site is operated by Thurlex Outdoor LLC, a limited liability company with its place of business at 3101 Park Boulevard, Palo Alto, CA 94306, United States. "Thurlex", "we", "us" and "our" mean that entity. "You" means the person using the site or placing an order. Contact: alex@thurlex.com, weekdays 9am–5pm Pacific.
2. You must be 18 or older
You must be at least 18 years old to buy from Thurlex. By placing an order you confirm you are 18 or older. You are also responsible for knowing whether the item you are ordering is legal to own, carry or receive where it is being delivered. Rules vary by state, county and city and they change. We cannot advise on what applies to you, and nothing on this site is legal advice. If we learn an order cannot lawfully be delivered, we cancel it and refund it in full.
3. Lawful use
Our products are sold as hand tools, for lawful use. You agree not to buy from us on behalf of anyone who is under 18 or who is prohibited from possessing the item, and not to resell our products in a way that breaks the law where you are.
4. Products, specifications and images
We work to describe our products accurately. Specifications come from our own measurements and our manufacturers, and images are of the actual product except where a page says otherwise. Colours vary between screens, and minor variation between units is normal in manufactured tools. If a product is listed with a materially wrong price or description, we may cancel the order and refund you in full rather than fulfil it, and we will tell you why.
5. Prices
Prices are in US dollars and include every mandatory charge. Sales tax and shipping are added at checkout and shown before you pay. We do not add handling, processing or service fees. Prices can change, but a change never applies to an order we have already accepted.
6. Orders and payment
Your order is an offer to buy. We accept it when we send you a shipping confirmation, and that is when the contract forms. Until then we may decline an order, including where an item is out of stock, where payment cannot be verified, where the delivery address is one we do not ship that item to, or where we reasonably suspect fraud. We charge your payment method when you place the order. If we cancel before shipping, we refund in full.
7. Returns and warranty
Our Returns & Refunds policy and our Limited Warranty form part of these terms. Where they say something more specific than this page, they govern.
8. Reviews and anything else you post
If you post a review or other content on our site, you keep ownership of it and give us permission to display and share it in connection with our products. Post honestly: do not review products you have not bought or used, do not post on behalf of anyone with an undisclosed connection to us, and disclose it if you received a product free or at a discount in exchange for a review.
We remove content that is spam, unlawful, abusive, or contains someone's personal information. We do not remove or hide reviews for being negative, and we do not edit reviews to change what they say.
9. Our intellectual property
The Thurlex name, logo, product names, photography and site content belong to us or our licensors. Please do not copy or reuse them commercially without written permission. You may share our product pages and photos for ordinary personal or editorial purposes with attribution.
10. Warranties and limits on liability
We provide the written Limited Warranty on our warranty page. Beyond that, and to the extent the law allows, the site is provided as-is and we do not warrant that it will be uninterrupted or error-free. To the extent the law allows, we are not liable for indirect, incidental, consequential or special damages arising from your use of this site. Where liability cannot be excluded, our total liability for any order is limited to the amount you paid for it.
These limits do not apply to anything that cannot lawfully be limited. Because we give a written warranty, we do not disclaim implied warranties, including the implied warranty of merchantability. Nothing in these terms limits your rights under the Song-Beverly Consumer Warranty Act, the Consumers Legal Remedies Act, or any other law that gives you rights you cannot waive.
11. Safety
Blades, axes and hammers cut and crush. Read the instructions supplied with a tool, keep edges covered when not in use, keep tools away from children, and wear eye protection when striking or splitting. Stop using a damaged tool and contact us.
12. If there is a dispute
Email us first at alex@thurlex.com. Most problems get solved that way and we would rather solve them than argue about them. If that does not work, these terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules, and any dispute will be brought in the state or federal courts located in Santa Clara County, California. Either of us can still bring a qualifying claim in small claims court. This section does not take away any non-waivable right you have under the law of the state you live in.
13. Privacy
How we handle personal information is set out in our Privacy Policy.
14. Changes
We may update these terms. The version in effect when you place an order is the one that applies to that order.
15. General
If a provision of these terms is unenforceable, the rest still applies. Our not enforcing something once does not waive it. These terms plus the policies they reference are the whole agreement between us about your order.
